Upgraded nomination wrongly rejected.

As shown in the pictures the pool is publicly accessible and isn't a privately owned home. It is a large apartment complex, the pool is located right next to the entrance which is right off the road so there's easy access for anyone walking by.
I used an upgrade on this so I'm very upset by the possibility of needing to resubmit... The upgrade is the only reason it went through voting, had been sitting in queue since September.

I agree that there is a logic that they should be treated the same, but Niantic has explicitly stated that pools are to be treated differently.
Okay so if apartment pools can't be approved, then can neighborhood pools be approved? I found one today that was brand new since I know it has been rejected in the past year.
