Unsure how to review this

I came across this edit while reviewing. It says - select the photos that don't meet the criteria. BUT the criteria matches the old photo of the closed coffee shop. The new coffee shop is currently what IS there. The photo edit that someone added was correct, but they should have edited the Title and Description as well.
If I do what it asks, I have to say that the old photo (red building) DOES meet the criteria and the new and correct photo does not... but it is actually Portside Coffee & Co.

Do the photos meet the criteria? That's all thats being asked with these photo reviews as far as I can see - just follow the guidelines in the link at the top of the page.
Hmm. Realistically, I think most reviewers would opt to duplicate it. They are functionally the same - both appear to be coffee shops so they are likely to both be eligible as a place to be social with others. But technically if the first coffee shop closed and a new one later opened up, it should be reported as invalid and then re-nominated. The original Wayspot was reviewed & found eligible based on its merit and the new shop should be judged accordingly, as well.
Duplicating them could be especially problematic as Niantic continues to punish reviewers with bans on things that aren't always clearly defined as abuse.
The problem here is that all we can do with this screen is say "Yes or No" to the question "Do these photos meet the photo criteria shown via the link on the page". While you would expect something like this to be used for checking if the photos actually feature the wayspot or to see if any are duplicates, the page has no facilities for that. Not good, I know, I would have hoped for more functionality from this page, but all Niantic have provided is the "Yes / No" feature. You don't have to bother with anything else, just "Do the phots meet criteria".
I think both photos meet the guidelines for the physical thing in that location. The name of that thing has changed but both of them are valid representations of the thing at a point in time.
For wayspots that have changed their appearance like murals or shops. Usually the local players will add the new photo then upvote the current correct photo so that the up to date appearance is shown.
Is the Wayspot for the building or for the business? The business itself likely closed. In the time it was closed, it should have been reported invalid and removed. Does the fact that eventually a new coffee shop opened up make it acceptable to change the POI? What if the location changed business into an auto shop?
I had a similar review a few weeks ago - what appeared to have originally been a cool looking diner well within eligibility that had closed and somebody had submitted a photo of an Applebee's. Applebee's is a generic restaurant chain that should (almost) never be a valid Wayspot, despite still clearly being the same building.
I'm especially curious because of how the current abuse situation is being handled. I would hate to approve a photo allowing the original intent of a Wayspot to be changed and then get hit with a 30 day ban.
Its unlikely this location closed for a significant amount of time. From what I understand the current owner took control in 2017 and has been called port side since then. Removal of a shop that is still a shop is extreme, there's not even that many players in this town to perform policing of the waypoints. Especially evident as it took over 3 years for a player to go hey this is different I'll submit a new photo.
With your applebees example the submitter may have been working on a removal though a photo change but of course there's better ways like new photospheres and the like.
While actions that Niantic takes shouldn't be considered criteria, in the past, Niantic has removed Wayspots for churches that changed denominations rather than accepting an edit for, say, a Baptist to a Nondenominational faith.
It's still a curious case that could use some clarification.
considering how its the community that does the edits now Niantic presumably has no part in not accepting edits for names so they wouldn't be able to remove a location when a name change was submitted.
Regardless its a long road to get an edit processed in this location, players are still getting edit responses from 2018 occasionally.
