Who got it wrong: the community or a Niantic reviewer?

I submitted 3 separate picnic shelters one morning at a local park. The sun was at a bad angle so getting a great picture was very challenging. None of the 3 pictures are very good but I wanted to make sure the shelter number was front and center so reviewers could distinguish between the 3 and not mark them duplicate.
All 3 almost immediately went into voting but Shelter 1 was grabbed by Niantic staff.
I will definitely admit, again, that all 3 photos are marginal. The community accepted 2 of the submissions and Niantic staff rejected the third.
Who got it right and who got it wrong?

There is no right or wrong in this instance, just difference of opinion.
Personally I would have rejected the last of your accepted POI's as a poor quality picture, and passed the Niantic reviewed one.
As you have said, all 3 are marginal and this kind of split opinion is likely to happen.
I think #1 and #3 should be rejected and #2 is kind of coin flip on the photo.
Also, if they're clustered I would be inclined to see them as one picnic area.
I included the picture for a recently accepted portal nomination. I took about 8 different photos. This was the only angle I could get that had no people in it. Curious to how many pictures people take of something they want to submit? It is the Choate House located in Crane Wildlife Preserve and is accessible by boat so I went on a tour so revisiting wasn't an option. The Choate House is nearly 300 years and the birthplace of Rufus Choate the first person to successfully use an insanity plea in a murder case if you're wondering was it is.
All of the photos are not great and I can see why some people would reject them, but I personally wouldn't. So long as I can clearly identify the object and the photos doesn't have an exaggerated tilt, I would give it a pass. But I wouldn't say that those rejecting because of the photos are wrong either.
I'm waiting on approval for a post with an attached picture. Basically, I'm wondering what quality of photo you'd approve if you knew that the submitter couldn't go back to take one and it is very unlikely someone would submit same subject matter. It's probably relevant because people will be visiting relatives and will be submitting stuff that they may not get to do again when visiting for Thanksgiving and Christmas.

Can we see them on satellite view or are they under the foliage?
I wouldn't have rejected because of the photos, but if they are close to each other I would consider them as one picnic area too.
They are good POI but the photos aren't in focus so I can understand rejection based on poor photos. NIANTIC internal review isn't brave enough to give a reason like they ask the community to do so it's only a guess.
They are 100 feet or more away from one another, not in a cluster. All are numbered for identification since people rent them.
They are under trees so you can’t see them from the satellite view. That’s what made the pictures challenging because the contrast from the bright sunshine sneaking through from the east at a low angle.
I’m not salty over the situation lol. I figured this is almost like an experiment with a subject group and a control group and I learned that Niantic reviewers are potentially more strict.
I will resubmit this afternoon with better lighting and it will be approved.
The rejected one specifically says “Low Quality Photo” on it as the rejection reason.
I would have voted against all of these. They’re all burry like there’s some kind of horrible filter on them. The numbers are very hard to see, so I probably would have thought they were duplicates as well, unless the map clearly showed different buildings, set apart from one another.
You say it was grabbed by Niantic staff, but the rejection reason isn't "Niantic Review Decision", which is what it should say if it was reviewed by Niantic themselves.
I only looked at the photos since the OP said it was a Niantic review. Unless NIANTIC internal review has changed to actually show reasons in the past few days I suspect that the OP is mistaken.
There should be no discussion about, which photo fulfills the reason "low quality photo".
This rejection reason has an explanation, that says, that it shall be used only in extreme situations like: the candidate is way too dark, extremely blurry, so that the candidate can't be identified.
All of the photos show obviously a pavillion or something like that. A place to be social. Wayfarer is no photo competition ..... remember, that players only have a god damn phone cam - not the expert equipment .....
Did the rejection mail actually say "Niantic review decision"? This would be a first where they've actually told a person why they've rejected a nomination.
I had a Nia rejection, too - I got two mails. One with a dumb reason, and one with Niantic review decision.

However here is an example of a nomination that Niantic reviewed and rejected without leaving any sort of explanation.
Unfortunately, that was the norm of Niantic rejections. It started with just a “.”, then they changed it to “Niantic Review Decision”, and now I think the email still says that with no rejection reasons shown on the website.
Maybe the pavilion rejection shows Niantic is going to start including rejection reasons but many people have reported nominations showing the Niantic balloon, no longer reflecting a Niantic balloon in the last few days. That also could have happened to your pavilion and it ended up being rejected by the community. I don’t know if there is a way to know for sure unless you ask locals if they reviewed it. I actually review in your area but haven’t been reviewing very much lately.
I found the email. Seems pretty generic to me with no mention of Niantic staff.
@sophielab-ING Is the picture you linked of a nomination that is already resolved? If not, I hope you have a fantastic description and supporting. That picture doesn't look like a gathering place at all. Or a place where it'd be OK to get out and explore.
As for the general question, "what quality of photo you'd approve if you knew that the submitter couldn't go back to take one"... here are some thoughts that reviewers probably have.

Photo tip, try and have the Sun at your back. Overcast days are always good too.
I find sunrise and sunset are really the best time, light gets defused.
