Additional information: The Wayspot was removed in December 2021 due to to me unknown reasons. The Wayspot displayed Wood Art from a local chainsaw carver. The wayspot is placed directly next to the business workshop, the sculptures itself are viewable and publicly accessible without crossing private, which makes them eligible according to the November AMA regarding private company ground (https://community.wayfarer.nianticlabs.com/discussion/10321/november-ama-your-questions-answered/p1). The store owner advertises his business on the wayspots address on Google Maps (https://www.google.com/maps/place/J%C3%B6rg+B%C3%A4%C3%9Fler/@50.7234537,12.8757246,19z/data=!3m1!4b1!4m5!3m4!1s0x47a7495de8bd547d:0x5a3bab31ef2a06ae!8m2!3d50.7234609!4d12.8763081) and on his own website (https://www.sculptor-art.de/impressum%20und%20kontakt.htm), he also installed advertisement for the workshop on this location, which can be also seen in the original wayspot picture. The sculptures are permanently installed on the ground, and are still there, as can be seen in the attached pictures to this discussion, including exif data and gps tags. I had to convert them from HEIC to jpg to upload them here, if you need the original or additional photos please let me know. Same goes for further other resources. Is it a home based business?
It is, but it doesn't lack customer parking and company advertising. You can, similarely to a store frontage, go to this Artist and discuss your order with the business. Since the business displays its chainsaw carved art publicly, and you don't have to cross the private property to access it or the wayspot, I still think its a genuine Wayspot.
If it is on the lot of a single family residence, it is ineligible under the exclusion criteria. It doesn't matter if the homeowner opens part of the property to customers. For one thing, if he ever sold the house the new owners may not feel the same way about random people loitering around their house.

I wouldn't count this as an argument. Restaurants can also regularely change owners, if they have a POI its the same situation. If the owner changes, there is the regular procedere to remove it. It's no difference between e.g. a public family restaurant POI or this chainsaw carver home business POI
