Wayspot not accepted, Really?

This is really getting anoying, Wayspots that are within the rules of Niantic are getting rejected all the time.
This time a mosaic Tile is rejected because of the following:
- season bound/ Private property
It's not on private property, you can see that on the picture.
And it's not season bound because it is a Art tile...
I used my upgrade for this one and now the upgrade is gone for what?
The criteria for the rejection is not justified.

Where was the nomination located?
There are multiple Mosaic tiles in every Ally between the houses.
U can see the tile from the street but I placed the wayspot in the ally.
It's not on private property, I could do the wayspot on the street, but that is not the real place of the tile.
