    This is because private property (such as that belonging to a business) is not the same as private residential property (a house where a person or family lives).

    When it comes to private residential property, nominations are meant to be rejected and can be removed if they shouldn't have been accepted.

    When it comes to nominations in places like private business properties though, they're not specifically ineligible as there's the potential for lots of different people to go there, such as if they work for the business or are visiting the business. Therefore not everyone who accesses the wayspot would be trespassing, as there are plenty of people who have legitimate access to it. That being said, an authority figure from the business/the landowner can request removal if they so desire.

    Niantic expects their players to be aware of their environment and not do anything silly that might get them into trouble. This means that not all wayspots will be accessible for all people. I imagine most people follow the rules and everything is OK for the most part. There's no need to ban wayspots from being on private business property.

    Niantic internally reviews your removal requests. When denied, you can appeal them at https://community.wayfarer.nianticlabs.com/categories/removal-appeals with additional supporting evidence.

    Please note, as was said above, for the sake of Wayfarer eligibility, only candidates on single family private residential property are ineligible. Gated communities, apartments, corporate complexes, and places restricted by pay entry are not ineligible for being private property. It is the responsibility of the Player to not trespass.

    So Niantic is refusing to remove those Wayspots and it's the responsibility for the player (mainly children) not to go there?

    Of course they're refusing to remove them. Like I said, there's nothing wrong with them.

    Regarding your comment about children, firstly I would imagine that the average player age across all Niantic games is more likely to be somewhere between 30 and 40 years old, as lots of us grew up on the original Pokémon games on the Gameboy. That aside though, children should be playing when accompanied by a responsible adult, and teenagers who have more freedom should already have an understanding of what trespassing is and why they shouldn't do it, so from that point of view they are responsible for their own actions when playing Niantic games.

    Honestly the complaint you have sounds more along the lines of the other faction in Ingress has access to some portals you can't access and it's annoying you because they use them to field and link. Am I right? Or is it a genuine case of you misinterpreting the rules you've seen?

    Hehe, it's actually the other way around, my faction controls the "unreachable" portals and I'll jump a fence anytime. Just wanted to level the playing field.
