Received the rejection email. It’s too dangerous to access to the portal: It's a lighthouse in a military zone, with no public and pedestrian access, so that’s forbidden according to the rules. In addiction it can be captured only by sea, with the risk of hitting rocks.
This portal can only be accessed via motor ship by the sea, but you can either get fined by marine guard since it's dangerous to get close to rocks (need to be 30 meters close and minimum distance by law is 150 meters) or you risk hitting the rocks and damaging your boat.
Here the link and a screen we're it's specified that the San Paolo Island is a military property (in italian: demanio militare) and there is no the permission to access and to navigate there (in italian: sono vietati lo sbarco e la navigazione).

Also for the Wayfarer Rules this portal is an "Ineligible location, place, or object" (https://niantic.helpshift.com/hc/en/21-wayfarer/faq/2774-rejection-criteria/?p=web):
It is therefore a dangerous portal, which if not eliminated could lead to injuries or accidents for "adventurous" agents.
So we ask to delete it for a safer game, thanks.

Your request was appropriately rejected. "Private Residential Access" is not the same as "Restricted Access". While waypoints on military bases no longer meet eligibility criteria, they also do not inherently meet removal criteria.

The point is: no actual player can capture the portal without risking damage to their boat or themselves. Players have already reached this in the past by risking to get hurt and effectively breaking marine law (and getting fined). What we are asking for is to remove a potential hazard in the game for players eager to capture a waypoint in the sea.
The island has a mooring point, so boats can safely dock. And if a boat can safely be moored on the island, then any point on the island is accessible to pedestrians. The fact that you need permission to be there is not a factor in determining whether a location has safe pedestrian access.
Those players absolutely should be charged with trespassing if they're not allowed there. Don't break laws, playing a game is no excuse. Not being able to access that location is a YOU problem, not a Niantic problem. There are plenty of restricted access places with waypoints.
Military service members often don't have the ability to leave their base. Did you stop to think AT ALL about how removing this waypoint would affect military personnel who play other Niantic games? If you were successful, they'd be completely blocked out.
Let's address the elephant in the room - several fields and links use that portal as an anchor. You're trying to get this POI removed for strategic purposes. THAT is abusing the reporting system. There is no arguing you can provide that would change Niantic's removal criteria.
Military base nominations ARE eligible, so long as they don't interfere with operations, AKA a non-operational area, and is open to base residents and guests.
This portal has been used over the years by both factions. There is no military full-time stationed in the island, it is probably visited by "legit" humans twice a year for maintenance. What we are trying to do here is prevent players (from any Niantic game) from getting in danger by trying to reach this POI. People have reached this some times during the years but if a tourist or someone less-experienced were to try to reach this POI, or simply because the weather conditions aren't good, they can get seriously hurt / damage their vessel. You are responsible for your own safety of course, but Niantic is responbile for making you "go" there because of the POI. The "report for trespassing" is useless, do i file a police report based on some logs on a mobile-phone game? I would get laughed at. I would be perfectly fine if there was a portal in the military area in the middle of the island where only military can access and not accessible by the sea, but that's not the case, this portal is a potential hazard for agents and trainers and we want to take care of it before someone gets hurt.
And I've seen plenty of reports going through for dangerous portals which can cause harm to players who are not too careful. I'll let Niantic be the judge for this.
I did not say you should be the one to go to the police for trespassing. You don't know from the logs if that portal was captured by someone legitimately there or not, and frankly it's inappropriate for you to assume.
You not being able to resist the 'allure' of going to the waypoint? Not removal criteria. Regardless, TheFarix already mentioned how authorized boats can dock nearby just fine and walk.

You're not providing any new information - don't trespass.
