Additional information: I don’t think there was any malicious intent by the trainer who submitted this wayspot but it is located on the wrong side of the sidewalk to be possible on public property. The library / pantry is next to a private residence driveway and in my opinion should be removed so players don’t congregate on someone’s lawn to access it. Thank you.

If it is on private residential property, then it is invalid. The ability to access it without trespassing doesn't play a role in this.
There is a few reasons why this is invalid. As mentioned above being on private property alone is one. There’s also criteria that states wayspots are to be at least 40 meters away from private residence. This is definitely closer than that. If me and a group of let’s say 6 people wants to sit at this stop with a lure that’s basically in someone’s driveway it would probably upset the homeowner. And lastly everyone could just but up a little library in their front lawn and get their own stops and gyms if it was allowed.
There is no such thing as a 40m rule. This is pure misinformation.
Agreed - Niantic have to remove wayspots within 40m on request, and reviewers have to take extra care to assess the location isn't on PRP if it appears to be within this distance, but wayspots are not prohibited from being within 40m of private residences.
Also, they explicitely talked about the 40m rule in the November AMA:
Can you clarify the definition of “private residential property?” Are multi-family residences included in this rejection reason? What about Wayspots that are within 40m of a private residence?
this would be the criteria I was referencing in my comment. So I suppose within 40m is not technically invalid as long as it is not on private residential property. However this stop is technically plotted on someone’s lawn next to their driveway.
