Appeal rejected, Misjudged.

Hello Niantic,
This morning my Appeal has been rejected. Probably due to a wrong assessment.
I quote the reason: Thanks for the appeal, Explorer! The object's location in question is in the middle of the road and does not have pedestrian access which does not meet the Wayfarer criteria.
This poi is on the sidewalk so it seems very accessible from the sidewalk.
Can you check the poi again?
Below are images and a Google Maps link to clarify.

Almost all Wayspots with Mozaïek tiles are removed in the Netherlands, unfortunately that’s because there was a mayor abuse.
We also have a lot of real mozaïek tiles in our city, because we have an art in the streets projects, they all got removed and I even got a warning because I submitted one (I didn’t know there was an mayor abuse issue)
To my knowledge the abuse was, theft of Mozaïek Tiles, Fake Mozaïek Tiles, wrongfully placed wayspots, Mass production (bought in a shop) etc.
Unfortunately also good wayspots are removed because of this major abuse :-(
My advice: just forget this wayspot, don’t try to resubmit.
So the good lead under the bad and you accept that?
But this is not about abuse. This has been incorrectly assessed as you can see in the images and on Google Street View.
Mosaic tiles have been available in several places in the Netherlands for longer than Pokemon Go or Ingress have existed. It is up to the wayferer team to make a clear distinction.
Except that Niantic are being half-ässed and had nukéd lots of mosaic tiles just because of this abuse and banned the submitters who nominate them without warning. If yours had been accepted instead then you'll had a good chance of getting yourself banned, too.
No acceptance, I just stopped submitting Wayspots because banning players who do their best is not a good solution. We’ve a Wayfarer community to accept or reject stops, not to ban or warn Pokémon Go or Ingress Players that don’t cheat.
Some Mozaïek tile wayspots existed for years, placed by the local gouvernement, and even that player got a 30 day ban.
So again my advice, don’t resubmit.
And as long as submitting a Wayspot is a risk, I don’t submit, I don’t even submit a new Photo or a removal request, I’m on a break until uploading is not a risk anymore 😴
