Removing poi, on private property
Hello Niantic,
Hopefully you will hear me this way.
Try several times to remove a poi that is on private property. Even the housing consultant cannot remove the POI.
It concerns this poi: jeu de boule court Gandhi
GPS location: 51.949290,5.244155
The jeu de boule court is located behind a senior complex that is only accessible to residents. as you can see in the images.
The residential consultant from Kleurrijk wonen has contacted via a request for POI removal.
can you remove these?

Under normal circumstances this would not meet the removal criteria, as it is in a communal area where people gather, even if it's only for residents and their guests. Private residential property only applies to single family residences, which this isn't.
Previous comment said what I was gon say perfectly sum things in a gated community or members only area is acceptable. Private property is for residential and restricted areas
Hmm... I contacted a surgery center after the driveway overhang was accepted when submitted as a pavilion and Ninatic refused to remove it. The person I emailed said she had asked for removal, but the Pokestop is still there. I never followed up with her since I didn't want to bother them more. I wonder if they just ignored her request as well. The name of that one is "REX Surgical Center" (35.754155,-78.809627)

The residents understood that the police think differently about this. Some young people who were playing Pokemon Go have been removed from here.
You should not trespass, as your game tells you this when you log in. However, there is no reason to remove a legitimate pokestop just because you personally can’t access it.
This isn’t private, the whole building can use it.
There’s also pokestops in zoo’s, amusement parks etc, which you can only access after paying money.
Only when this causes disturbances then it might qualify for removal.
@29andCounting-PGO pretty much sums it up. You should not trespass if you have no business there yourself, but the location is still perfectly valid for anyone who does have a legitimate reason to be there.

And a zoo is an amusement park where people want to come and watch when you grant access.

No, just because YOU cannot reach it does NOT make it ineligible.

Why not just move on and leave it for the enjoyment of the people who can access it since both Niantic and comments here have said why it shouldn't be removed?
No, but you do have access to communal areas on the grounds of those apartments, such as shared green spaces and other shared amenities. The boules court is not contained within any individual residence in the complex, it's in a communal outdoor area where anyone who lives in the complex or their guests can enjoy a game of boules. If you are not a resident or a guest, then don't trespass, but it's still perfectly valid for anyone who does have access.

What does 'Prohibited entry Article 461 of the Criminal Code' actually mean? Literally the following is stated in the Criminal Code: “Anyone who, without being sufficiently entitled to do so, is present or allows cattle to roam on someone else's property, access to which is clearly prohibited by the person entitled to him, will be punished . with a first category fine.
So I can submit the tickets to Niantic?
Just because a pokestop is located there does not give you the right to trespass. It’s pretty simple really.
You've already been told, Niantic expects you not to trespass, but limited access wayspots are perfectly valid. It's not a difficult concept to grasp. Please stop being so awkward about it.
It means nothing it just means that not everyone from the public is allowed in, which does NOT make it ineligible.
You should submit a ticket to get your wayfarer privileges revoked... Since you refuse to follow their rules.
Seriously, I just showed you the exact rules as written here on the Wayfarer website in the review flow, if you can't follow that you shouldn't be submitting, reviewing, or reporting.

Others have explained clearly the situation. There is nothing fundamentally wrong with this location.
In the original post, I read this as that the property manager had requested the removal and it still has not been removed: "The residential consultant from Kleurrijk wonen has contacted via a request for POI removal." I thought that was the issue, not that Niantic would not remove the Wayspot for the player. This has taken a turn since I commented. If the OP was trying to submit FOR the consultant, they should have the consultant fill out this form themselves instead: https://www.pokemongolive.com/report-location
It sounds more like OP is trying their damndest to get these POIs removed because they don't like that they can't reach them. It annoys them and hurts their feelings that they can't access the gym or portal or whatever.
Niantic refused to remove them, so it looks like OP made some sob story about how it could cause nuisances or problems for the complex and sent an email to the company. Based on the (poorly) translated wording. This would also depend on timestamps. I have a feeling the management just sent an email back so they wouldn't get more emails.
The way the OP is arguing (and being confidently incorrect) makes this seem doubly so that these waypoints have never been an issue, nor did the complex request that they be removed and they are acting on their behalf.
This smells like abuse if they keep trying to get them removed.
If there is truly an issue and the property owners want it removed, they should follow the link https://www.pokemongolive.com/report-location, otherwise this should just be dropped by OP because these are perfectly eligible and do not fit any removal criteria at this time.
The property owner followed the link and filled in the form. But nothing happend.
I was playing there pkmn go with my kids for sevrel times. And we try the boost the stop. After a couple of days the older people who life there start too complaning. I told the older people what we were doing there. But the don't accept it and called the police. Than the Boa's came and asked about the situation. The told me too get in contact with the property owner from kleurrijk wonen. Sow i called the property owner and told the story. And he said if people who life there has problem with it than i should remove the playing point in the game.
My partner made the stop, with the same thoughts. But now the community is suffering from it.

My experience is that Niantic take property owner requests seriously and act promptly. If the property owner has not had a response then it is up to them to follow it up. It’s is not something you can or should act on their behalf.
if your gameplay actions are causing others distress then if I was in your position I would not try to justify what I was doing but would simply apologise and stop the action that was the causing the issue. It sounds as though it was the scanning that was problematic and you don’t need to do that so can go to another location. There is no reason anyone should need to notice someone simply spinning as they walk past or engaging with a rocket stop as again you can keep moving. Similar applies if it’s a gym. If you know it’s causing distress avoid organising a raid there.
There is no need for this to escalate, but if the property wishes it to go it is solely up to them. From the wayfarer perspective this is a valid wayspot and there is no other role for wayfarer in this case.
