Submitter should have retook this picture without the person. It won't cost them 10 minutes.
Still, it is on voting stage, does this count as "recognisable face"?

I agree that the submitter should have attempted to avoid the person, but as long as they aren't the focus of the picture, posing for the camera, or overly distracting, then I say it's fine.
In this particular the case, the person seems to be doing something ritualistic and keeping with the waypoint, which I'd be happy to vote positively on.

Yeah I don't see an issue with this one, I even had to look again to spot the person because they are not the focus of the picture and you can't see their face.

I can't see his face 😁 but I am sure plenty of reviewers out there still reporting this submission as "recognisable face"

In all seriousness, that may be a concern, regardless of whether or not it should be rejected, trying to weigh if others would reject.
"Potentially confusing nominations" gives us two extreme examples, whereas yours is obviously in the middle. You are correct the person making the submission could probably have waited for a more opportune picture, however there are times when that just really isn't an option. Unless you knew the person, you likely couldn't identify them from silhouette alone. The person doesn't look intentionally staged or posed there. I would approve, but I may be more critical of future nominations if I suspected nominations were intentionally including the same person.
There's nothing wrong with that
1. Not submitter identifiable
2. The person is not the focus of the picture
3. The persons face isn't identifiable
