This portal is ineligible because it's on a private property. The waypoint is not accessible by public. It's a Banquet hall called "Sarada Palace" Barasat.

If it's in a banquet hall, it's eligible. Being located on private property is perfectly okay, as long as it's not single-family residential property.
If the fountain actually exists and people (visitors, employees, customers etc.) can safely approach it, it should (and will) not be removed.
If it doesn't accessible by public. It should be removed.

How does “publicly accessible” apply to locations that have limited access, like members-only clubs, gated communities, time-restricted areas?
Just like with the definition of private residential property, this guideline hasn’t changed. These locations would still be eligible, including restricted areas on the grounds of a company’s headquarters or behind locked gates so long as there wouldn’t be objections to you entering the area and the location is accessible to some folks. We do not expect all players to have access to all locations but we strongly recommend following real-world rules while attempting to access locations.
So the rules say (as they have always said) that restricted access is okay.
Appeal Denied - Thanks for the appeal, Trainer. We took another look at the Pokéstop/Gym in question and decided that it does not meet our criteria for removal at this time
