Additional information: Here is a legal photo of the portal. The portal submitter clearly trespassed onto this property with a posted NO TRESSPASSING sign to take the photo. The iron fence is clearly meant to keep people out of the private property, and this is NOT an entrance to the park. Rather, it is just a generic boundary sign.

If this isn't private residential property (the grounds of a single family dwelling), then it doesn't meet the removal criteria. Given that it's a county park, I would assume it's not private residential property. Do you have any additional evidence to prove that it is?
The park is up against Private residential property. It is not an entrance, but a park boundary sign. The original submitter needed to trespass to get the photo as seen in my submitted photo from county property, and it suggests that coming from the private property is the way to gain access.
But can you reach the Waypoint by walking through the park, avoiding the next door "private property". If so, then the Waypoint would be valid.
The Wayspot may be removed because it was submitted under false pretenses and could be classified as a fake Wayspot. But as far as location goes, Ninatic will likely view the fence as part of the park's property and there is no clear evidence that the property next to it is a single family home.
Appeal Denied - Thanks for the appeal, Agent. We took another look at the Wayspot in question and decided that it does not meet our criteria for removal at this time.
