The local council that maintains this cemetery forbids the playing of games in the cemetery rule 9.
There are numerous hazards to get to the poi freshly dug graves people can fall into and people are disrespectful walking over graves and disturbing mourners to interact with the poi, the rules for the cemetery make it perfectly clear no games aloud and to be respectful and quite which can't be achieved if there is a group of people playing a Niantic game.
Thank you for your consideration Niantic, to anyone else read the rules of the cemetery and look at screenshot where you physically have to stand in the cemetery to interact with the poi.

The local council have more important situations to worry about then a mobile game.
I'm correctly using these forums to make a valid request as anyone can see playing games in the cemetery is not aloud for numerous reasons and walking across graves just to access something in a mobile game is not appropriate.
It's not a valid request, because the cemetery doesn't objectively meet removal criteria. Since it's a request outside of the normal removal criteria, the local council would have to contact Niantic. It not being their priority does not give you agency over their property.
A request like that can only be made by the local council or the cemetery's manager directly to Niantic. Players cannot act as an intermediary on behalf of the property owner.
Let Niantic see the evidence I don't like being heckled on a internet forum when I thought I'm only making a valid request.
As others have said, you are not the owner of the cemetery, so you can't really request to have it removed because it doesn't otherwise meet the removal criteria.
That being said, I understand your concern, and I do think it's a bit strange/disrespectful that a wayspot for a cemetery is in the middle of some graves. So, if Niantic read this, I propose an alternate solution would be to suggest the wayspot is moved to 51.446177,-0.441436 instead. This location is the coordinates of the Bedfont Road pedestrian entrance to the cemetery. The entrance is the natural point of ingress into the cemetery, meaning it's a much more logical choice for wayspot placement, and no one would actually have to enter the cemetery to reach the wayspot, meaning no unnecessary walking over graves.
I just want to see what Niantic say I don't like the atmosphere on these forums though it's not nasty it's like I'm constantly being looked down on and belittled for making a simple request again and again " your wrong and we are right "
If Niantic don't do anything I'll message the council and I don't think there is any point of just moving it though I can see the logic the rules make it seem like it's disrespectful just leave the cemetery in peace.
Please anyone else it's been mentioned a bunch and I feel bad for making this thread I've been told plenty already I shouldn't of bothered posting on here and should let the council do it instead.
Even though as an ingress agent I can report any portal in game and not have a message pop up and mention " if this is private land or a sensitive location make sure to contact the proper authorities " I'll get it done by Niantic's forums thank you very much.
I only posted what I did as I was aware you've requested this before on the forum and it was rejected by Giffard back then. I'm not trying to look down on you or belittle you.
Niantic hasn't changed their removal criteria since you made that post, so in all likelihood this post will end up with the same outcome.
As I said, I completely understand your issue with the fact it's right in the middle of several graves, and that really isn't an ideal spot for it. That's why I suggested getting it moved to the entrance instead, as Niantic may be willing to do that given that they've previously declined to remove it from the database. A less intrusive position would be better than them doing nothing, right?
Rules are rules ' rule 9 games aren't aloud ' and perhaps I didn't make my case clear enough back then, hence my new evidence you know showing the rules of the cemetery mentioning no games aloud, only moving it just moves the problem.
Like recently a dangerous portal was removed after a thew attempts I'm sure after you was checking my posts you saw that and knew I would bring it up now.
Improve my evidence hopefully get a different outcome and funnily enough obeying the rules of the cemetery and respecting people's privacy when they visit the cemetery.
Personally would remove all wayspots from all cemeteries. Even important one's.

I think that at some time in the past Niantic used to remove them, now it's a matter of luck.
Given that in this case there are specific rules against playing in this cemetery, Niantic should obey them.
I remember that, also my last post was rather weak I didn't show the actual rules of the cemetery.
I think that Wayspot does meet the requirement for removal. As it's stated in the public rules of that place (no games allowed), players (and Niantic themselves) ignoring that rule will automatically violate Niantic's terms of service:
"You agree that [..] you will not use the Services to violate any applicable law, regulation [..]"
It would be contradictory if Niantic demands this from a player, but actively facilitates Wayspots in areas where, per regulation, you are not allowed to play.

@NianticGiffard it's been a month and people are still in groups in the middle of the cemetery where the portal is located heared verbally saying " it's a hundred percent "
It's against the cemetery rules put there by the local council games are not aloud IE mobile games are included in that.

Thanks for the appeal, @Goddess1974-ING! We took another look at the Portal in question and decided that it does not meet our criteria for removal at this time.
Ok then even though games are not aloud in the cemetery including Niantic games.
Council states this in the rules provided via screenshot and the poi being located directly in the middle of the cemetery. It's only a cemetery no important historical person present and even in your own rules we are told to obey rules and regulations adhere to them at all times don't brake them to play Niantic games.

If regulations prohibit playing, just don't play. Niantic always says that nothing can replace common sense. The owner of the cemetery can always request that a POI be deleted: https://pokemongolive.com/report-location/
