Additional information: The trail you can see on the map no longer exists since the area marked in the circle is no longer accessable this is a place where rare european birds have their breeding zone now its noted as Werf zone since a long time ago they used this place as a dump recently cleaned everything up and did block the entrance with fallen trees if you want to access this area the only way is to climb over a wall of fallen pine trees of about 1 meter high and the risk of getting a fine and as last the info sign no longer does exist they took it away since nobody is allowed to get over there anymore its impossible to make a picture since it has become a swamp and too many fallen trees and weeds of over 2 meters high

Thanks for reaching out, @EternalMayhem-ING! We took another look at the Wayspot in question and decided that it does not meet our criteria for removal at this time.
What kind of proof do i have to provide? like i can make some pictures of the entrance being blocked on purpose you can climb over it but that would be tresspassing
maybe some statement on the internet on the government or local city website will help.
I would also like to ask you to reconsider this decision.
From what @EternalMayhem-ING described, this location is obviously inaccessible should not be trespassed on.
In addition, the European Union has laws that protect wildlife under the EU Habitats and Birds Directives, and Belgium also has state-protected areas. Bird population numbers are declining across the globe. Birds that are disturbed while nesting can even become stressed enough to abandon their nests, leading to further population decline. It takes cooperation from everyone to protect nature: government entities, individual citizens, and private companies.
Unfortunately, some selfish players are motivated only by gaining an advantage in their game of choice and do not care about trespassing or harming wildlife. A splash screen with "Please do not trespass while playing [Game]" is not enough to deter these players. Of course, they are responsible for their own actions, but it would look really bad if they claimed that the presence of a poi in a Niantic game encouraged them to trespass.
We need everyone's help to protect wildlife. Niantic can play their part by removing wayspots located in areas that have been completely devoted to use by wildlife. Thank you.
I really think evidence from an official source would benefit you. On intel and Google maps, the portal appears to be accessible. There is a photosphere and it is owned by a player. A statement or notice from a government entity that shows the status of the location has changed would help.
This is what i found online the breeding zone is in the "Bosbeekvallei" which is in the list on this site
and on this site you see the area that is marked also the location of this portal https://natura2000.vlaanderen.be/natura-2000-gebieden
this is the only portal in this area that is no longer public or accesable there used to be a hiking trail of "Natuurpunt" that went through this location but they removed the trail as well there are a few new hiking trails that go through accessable area where you don't harm any nature or animals
Another thing to point out, is that even if this is a restricted area, that doesn't automatically make it invalid. As long as SOMEONE has access to it, it is perfectly fine.
Nobody has access to it since anyone that would access will disturb the birds they blocked the path towards it so even themself aren't allowed to enter anymore just a piece of nature that can't be accessed by anyone anymore or well legally

So i went again the picture above is the entrance its only blocked but it doesn't say i can't enter so i did enter the spot and following geotagged photos are of the portals location of it no longer existing
So you accessed the “no access” breeding zone for birds to have a portal removed. Brilliant.
Without the online research i wouldn't have a clue either look at the top picure path is blocked but there is no sign or whatsoever that tells me i can't access it so i figured if they are not gonna put a sign down that i will make a geotagged picture of the portal no longer existing the trees could of been knocked down by a storm who knows 😅
After reviewing the additional evidence provided, we’ve decided to retire the Wayspot in question.
