in ingress the game master told us not to trespassing to others property. so, i am so sorry if other agent want to hack portal that has been submitted by the thread starter, they need to go to jail because trespassing. shall i advice them to look for you for lawyer fee?

Is it that easy to ask permission to enter the factory in your area? because in my area, ANY reason that didn't have any connection to task or job from the factory itself will be prohibited to enter the factory.
are you really don't care if the gym can't be access by you as public? for me, my community that always need to go to the place to interact with either gym or portal, it's one of the criteria the wayspot to be live. if you can't access it, so why you submit it? unless for spoofer, they don't care is it private property or not, they can access it. If it Private Property, Ingress and Pokemon Go always remind us by the notification that always pop up every day " Do Not trespass while playing Ingress" of course it means ingress or Pokemon Go don't want us to go inside Private Property without any permission. Private Property is different with Public Area of course.
If you have proof that OP is trespassing/spoofing, report that to the authorities. If none, assume the submitter has the privelege of access.
Did you probably assume that "publicly accessible" = not private property? That is a too common fallacy. Refer to this AMA, limited-access/criteria question 2:

It isn't the type of property that gives the problem of trespassing but the player's behavior. You've been told that public areas also have restrictions for entry, going out of those restrictions are considered trespassing as well. That notification is a reminder for the player to follow real rules (gameplay issue), it doesn't discount that some types of private properties are eligible locations within the Wayfarer criteria.
Note that the rejection criteria only references one type of private property to be explicitly ineligible. The rest have no references towards being private/public but ineligible due to other contexts.

Seems awkward that we already have Bahasa Indonesia language support in Pokemon GO for months yet there is none in Wayfarer (and I assume Ingress too?).
@GurameBakar-ING I've been playing Ingress for ten years, and I've been playing PoGo since the closed beta. There are plenty of places that I've been unable to access for a variety of reasons.
Since you have -ING at the end of your handle I assume you understand that restricted access portals can have high tactical/strategic value as anchors for fields and blockers to make it hard for your opponents to field. Many people have gone to great lengths to access some of these portals, including chartering boats, planes, snowmobiles, and helicopters. It's part of what makes Ingress fun and interesting, and yes sometimes challenging and frustrating. I have occasionally asked for permission to enter a place that I would not normally have been able to enter although it's not the sort of thing that I would do at a factory. I've done it at a corporate campus, though. "Hello, security guard. I was walking by and noticed that really cool sculpture over there. Would it be possible for me to come in and take a photo of it, please?"
If I can't access a portal in the middle of a factory that's fine with me... there are plenty of other ones in the world.

It means that some members of the public (who is not the owner) has access to the location. Workers at a factory are members of the public. Visitors to the factory are also members of the public. However public access does not mean that all members of the public have access to the location.
