I'm sorry but you're wrong here. It's an art gallery, you must come in to see it, it need to have safety acces for it. And in other streetview look you can clearly see that there is plenty of place to stand near this building, it has some pavement near entry:

You just have to come in to Gallery ground. And even when gate is closed you can stand safetly next to this gate, there is still plenty of space for it.
I circled both safe space on this screenshot of streetview.

So it's perfectly safe and there isn't any reason for it removal.
You can't walk into the entry point though or near it because it's on a street.

Safe acces means that you can stand near POI in safe way to play and nothing dangerous would happen to you. There is a lot of place to do that, even from art gallery itself. It must be a safe place, as it is art gallery - how people visit it if it's not a safe place?
Maybe It's a POI with restricted acces (when gallery is closed), but it's not a reason for removal. If at least one person can acces it safetly (like workers of this art galerry) then it's eligible POI and shouldn't be removed.
It's clearly in a patio area meant for pedestrian traffic, so the flag poles have pedestrian access. There is also a parking lot next to the building lading two the patio. Just because there is no sidewalk next along the several yards away doesn't mean that anything at the art gallery is ineligible.
The issue is that there is no pedestrian access into the art gallery itself. Shouldn't wayspots be accessible for all ages and methods of travel? A child/teen could potentially be hurt/killed attempting to try to visit the wayspot by foot or by bike.
There is pedestrian access from the parking lot to the building itself, which also passes thorugh the patio area. The patio area is clearly designed to be a pedstrian area and the flag poles are located in the patio area. Pedestrian access does not have to originate from the street; a parking lot or a building is sufficient.

Okay, but they don't have pedestrian access to the parking lot which means they wouldn't be able to reach the portal.
The red path is not pedestrian accessible because it requires you to be on the street to be able to get to the parking lot. The green path is pedestrian accessible because you are in the parking lot which does have a pathway/sidewalk to the wayspot. But you can't get to the pedestrian accessible area until you get into the parking lot which isn't pedestrian accessible from the street.
You can safely go to the parking lot in a car, and from that location you can walk to the spot.
Your claims is like stating that anything in an island is not pedestrian accessible because in order to get there I have to go by boat or airplain.
A driveway is still a mixed traffic area and is treated as a place where pedestrians are expected to be in, just like the parking lot. That also does not overlooked the fact that the patio is intended to be a pedestrian area in and of itself and that it is directly accessible from the building as well. In short, if an object is in an area where pedestrian are intended or expected to be in, then the object has pedestrian access.
