Very much appears to be on private residential property
This is on street level. It is but one of the many shrines in Mexico devoted to religious cult. Mainly, on Dec 12, people do parties to celebrate them. For many neighbourhoods, these may be their only way to have wayspots on their area. By following this rule, 90 % of portals should be reported, and then, deleted.
Doubts? Check all other portals near these:
Wayspots are not allowed on private residential property. No exceptions. If there are other Wayspots on private residential property, then should be reported for removal.
Per the criteria:
Nominations and edit submissions must meet all of the following acceptance criteria:
Wayspot in question is not against any of the mentioned criteria.
September 2020 AMA:
When is it appropriate to report an invalid Wayspot? How can these reports be made if you’re not a business or property owner (or otherwise authorized individual)? What should be avoided when considering whether or not to report invalid Wayspots?
Wayspots that fall under the following categories can be reported via the Ingress Scanner or the Pokémon GO app:
* No Pedestrian Access
* Obstructs or interferes with Emergency Services
* Private Residential Property
* School (up to K12; including Day care/Child care services)
* Permanently removed from the location
* Duplicate of another Portal
For all other cases, we’ll review the location if the (verified) property owner contacts us via the form provided in the Pokémon GO or Ingress Help centers. If you’ve reported a location via the Pokémon GO app or the Ingress Scanner and the request has been rejected, you can appeal the decision in the Wayfarer forum if you have additional proof to share
Looks like you have not clicked on the Google Maps link. It's open, the place, itself, is not Private Residential Property. It's like any other wayspot I shared with you before.
Appeal Denied - Thanks for the appeal, Agent. We have taken another look but stand by our decision to retire this Portal.
Around 90 % of Wayspots in the region are like this. I will start reporting all of them and I hope the same decission is taken from you.
Well, check these cases where @NianticGiffard decided that this rule does not matter:

https://community.wayfarer.nianticlabs.com/discussion/16839/invalid-wayspot-appeal#latest Again, fenced wayspot in residential property
https://community.wayfarer.nianticlabs.com/discussion/16840/invalid-wayspot-appeal#latest Wayspot ON TOP of residential property (you can't get close to it, of course)
And, many, many, many more nearby.
