This waypoint was bought online AFTER the moratorium on new military base waypoints, and as such should be removed. (Or never approved in first place).
This waypoint is located on a military base, access is restricted to authorised Defense Department personnel only.
Although the waypoint is relatively close to the fence, the adjoining land is also restricted area. (See picture of sign, (of which there are many).

Niantic has stated they will not remove existing military portals unless requested by the proper personnel.
Yes- this one somehow got approved despite the new guidelines. I clearly state in my post this one was bought online AFTER the ban on new waypoints on military bases.
Appeal Denied - Thanks for the appeal, Agent. We took another look at the Portal in question and decided that it does not meet our criteria for removal at this time.
New portals are no longer supposed to be accepted on military grounds, but once they have been accepted, they do not meet any of the criteria that would invalidate them. I like that. No sarcasm. I am glad that there are such portals and that the appeal was not accepted. 😎

The Defense Act of 1903.
Specifically section 82.
People are breaking the law submitting these. The waypoint was submitted AFTER the official Niantic statement release of no new military base portals and only became live due to organized voting.
Military base nominations are acceptable so long as the waypoint does not interfere with operations.

That is NOT what that clarification post states. It's not open to the general public or in any kind of public area.
portals in gated communities are also not accessible to most people and are accepted. you have to get used to not going everywhere
(5) In this section:
defence installation means any fort, battery, fieldwork, fortification, aircraft, air force establishment or aircraft material or any naval, military or air force work of defence.
Can you tell me which of these definitions barracks would fall under? I would've thought that barracks would be specifically mentioned if they were to be included, as legislation usually has to have very specific wording.
