Personally i use upgrades for things that are very easily passed like playgrounds churches and sport fields. Try it without and see if anything changes

Niantic in discussions have said not to apply local laws to determine whats prp or not. Also under the help section they have a blurb on private property as well

Do not orientate your submissions off of previously accepted stops. Cemeteries are considered sensible location they are not eligible. How ever some things in the cemetery may be eligible

If it has the name of the beach on it I would accept it. Or if it was a specific spot to anchor the poi to I’d be inclined to accept if proper ifno was given
