    The playground appears to be on a common area for multi family building (multiple homes).

    It may look like this from the satellite view of the building, but it's fenced off, and each family has their own piece of land. At first I thought that too, until I saw it on site and got strange looks from the residents. There is only one family that has access to it. And even if it is, it is still not an official playground but something cheap that anyone can order on the Internet. Right next to a registered kindergarten.

    From my point of view this should not be a wayspot and should be deleted. And even if Niantic decides against it, at least the fake attempt should be examined there!

    Please do not comment further and influence Niantic in their decision.

    This is a private playground, how you can buy the equipment at evry bigger hardware store. So it's not an official playground, detected at a first glance. For exampe a public playground in Germany wouldn't have a plastic slide. There are lots of rules, laws and certifications, that are necessary for public German playgrounds: for example the railing of the slide is too small....

    Don't comment on evrything, only because commenting is possible 🤦‍♂️

    Was sharing my observation which may or may not be what Niantic sees also, overcoming those thoughts makes the appeal stronger. Wayfarer responded politely. My suggestion would be to show photos of the fenced area proving it is for one home only.

    The problem is, it is actually a building that several families live in. However, each family has its own small front yard. The Wayspot is only in one of the gardens, it doesn't belong to everyone.

    It all seems temporary and private!

    When I took these photos, I was already being watched with suspicion by the residents. So I didn't take any more photos to avoid getting into trouble.

    I have no idea what was going on, but my submission suddenly went into vote today and was accepted. Lucky. Now the fraudster has no more chance. I am happy that I was successful. A qualitative wayspot in the right place. ☺️

    Al parecer ya se está transformando en un llamado pasivo de parte de @NianticGiffard no revisar evidencia clara y contundente de zonas no válidas para los Wayspot.

    Debería ser un tema tratado en el futuro AMA sobre que entiende NIA por propiedad privada. Esos juegos infantiles es muy claro que son juegos comprados en una ferretería o sitios de entretenimiento, instalados para solo un pequeño grupo de personas que viven en un sitio privado.

    Insisto en la pregunta ¿Cómo pueden acceder los jugadores que no sean residentes del lugar?


    1.- Insisto en que la respuesta es violación de morada (cometer delito)

    2.- Ocupar aplicación para falsear ubicación.

    Si puedes responder de otra forma ¿como? puede acceder te agradezco que nos digas como acceder a zonas de este tipo.

    You say it's "very clear" that this is ineligible. I say, and Niantic appears to agree with me, that this is not the case.

    It is an old and well-established rule that private residential property only means single-family homes and farms. This building appears to house multiple families. Now, if the playground equipment would be located in a fenced-off part that only a single family has access to, I'd say it's clearly ineligible. However, I see nothing on Satellite View that indicates a demarcation - it seems to be accessible and usable for all families residing in (or visiting) the building. That makes it eligible.

    Al perecer no revisaste bien la evidencia @Nadiwereb-PGO y el hilo completo mirando las fotos aportadas por @caminanteMSE se notan claramente las rejas y que es acceso es prohibido.

    Insisto si el lugar tiene reja ¿como accede una persona que no vive en ese sitio? Está pregunta no ha Sido respondida ni por ti ni por el equipo de Niantic.

    Francamente es una mala interpretación de lo que significa una propiedad privada, en general trae estos problemas si es unifamiliar, multi familiar etc, ese no es el punto de importancia si viven 5 o 10 familias en un sitio, el punto es si es público o privado y si tiene acceso o es prohibido.

    Sostengo la tesis que todo sitio, lugar, edificio, industria, o cualquier propiedad privada no es un lugar apto para el juego y es lo que ningún jugador especialmente los de Pokémon les cuesta entender porque todos quieren un homewaypot o el gym en su sofá para no moverse, lo cual es todo lo contrario al ethos de los juegos Nia.

    Your whole starting point is flawed unfortunately.

    Yes, access to the building is restricted and - presumably - only residents and their guests/visitors are allowed to enter. However, that is completely okay by Wayfarer rules, as long as the PoI doesn't belong to a single-family resindential home. If this playground is accessible to all (more than 1) families that live in the building, it is considered communal and eligible. If it belongs to a single unit (and separated from all others with a fence, for example), it is private and ineligible.

    So yes, its eligibility very much depends on whether there are 5 or 10 families living there with access to it. As a matter of fact, it is the most important question here.

    Entiendo perfectamente y conozco muy bien los criterios de Wayfarer. Es justamente este mal criterio de Wayfarer lo que origina el asunto principal de mi planteamiento.

    El caso concreto es que este tipo de criterio de aceptación de Wayfarer es una política mala porque da origen a "una situación de si accedes o no a un sitio con permiso de los dueños". Pedir permiso para acceder a un sitio, lugar es porque no es un sitio público.

    Cómo consecuencia solo se beneficia un grupo limitado lo que crea por si solo desventaja de uno a otros jugadores. Sin que los solicitante del Wayspot tengan la culpa.

    Y aún no respondes mi pregunta @Nadiwereb-PGO ¿Como accede una persona que no vive en este sitio? (Favor observa las fotos de las rejas) que sucede si los residentes se oponen a qué accedas ¿Que debe hacer el jugador?

    En la lógica de juego para Pokémon este criterio no es tan perjudicial ya que si es un gym o pokeparada para una pequeña comunidad no es una ventaja significativa para un solo jugador, por lo contrario se beneficia una pequeña comunidad.

    En la lógica de ingress es totalmente diferente ya que un portal sin acceso da una enorme ventaja para crear campos, granjas de farmeo entre otras jugadas de táctica de ingress y sumar un puntaje de CF para la facción que tenga el dominio, es por tanto una ventaja injusta y que no podrás borrar de las estadísticas.

    Situación muy similares son los Wayspot que están en zonas industriales, Minería, industria eléctrica, etc. Sitios que no puedes acceder y no podrás acceder nunca porque ponen en riesgo tu integridad.

    Las mecánicas de juego son diferentes y lo que en un juego no afecta en el otro si y mucho. Por esto al momento de votar debes pensar para todos los juego de NIA y no solo lo que conviene a Pokémon.

    Finalmente todo Wayspot aunque se envíe desde Pokémon aparece en ingress, pero no todos los portales de ingress aparecen en Pokémon y este era el motivo principal que ambos juegos tenían separadas las solicitudes y revisiones.

    First of all: what my opinion on the subject is does not matter. Ninatic has made it extremely clear multiple times that restricted access is okay. To add to what @Roli112-PGO has already posted, the 2020 November AMA (the one after the change of criteria) also confirmed that restricted access is okay and that community amenities (like playgrounds) of multi-family residences are eligible. So my personal opinion on the matter is completely irrelevant.

    Second: a restriced-access PoI can very much be a problem or nuisance in Pokémon Go as well. There is an EX gym in an office complex near me that is only accessible to workers and visitors. Also, I'm perfectly aware of Ingress gameplay mechanics, so I know what you're talking about. But the answer is what it always has been: just because a portal/stop/gym is there, you don't have to engage with it. That's the "reality" part of augmented reality: not everything is accessible to everyone.

    En realidad si es impresionante nuestra discusión y argumentos como jugadores @Roli112-PGO y @Nadiwereb-PGO gracias a opiniones de los jugadores es que la comunidad ha crecido y mejorado en todos los juegos NIA. Si no fueran importantes nuestras opiniones pues NIA simplemente no tendría a tantos jugadores designados para Vanguard, XM community, Thrusted Reported, etc etc.

    En efecto, somos los jugadores quien a través de opinión, testeo de juego y micropagos damos el principal soporte para que estos juegos existan @Nadiwereb-PGO esto no quiere decir que todo lo que diga NIA en sus AMA o TOS son acertadas y correctas, el crecimiento es un proceso de mejora continúa y debe alimentarse de las opiniones de los jugadores.

    Si bien es cierto que el asunto a Sido tratado en AMA @Nadiwereb-PGO siempre se fórmula mal porque hay consepctos que incorrectos.

    Este ejemplo es contradictorio a las mismas políticas de aprobación y rechazo que tú indicaste " indica que no es válido un Wayspot que se coloque de manera deliberada o estratégica para dar ventaja a un jugador o a un colectivo" pues claramente el concepto de "ventaja" aparece como un motivo de no apto. Sin embargo en los mismos AMA de Noviembre se realizó está pregunta y fue mal respondida por NIA porque se refiere con "ubicación ligada al abuso" a propuestas falsas que es un asunto distinto y claramente una propuesta falsa da ventaja a quien sea.


    Otro ejemplo acá indica "ubicación no segura, sin acceso peatonal"

    Luego sin acceso peatonal, principalmente este criterio se ha ocupado para los casos de rotondas o intersecciónes de carretera, aún así no hay un detalle claro de ejemplos sin acceso peatonal.

    La respuesta en Ama que el acceso peatonal seguros es poder acceder al Wayspot "caminando sin exponerte" entonces hay dos conceptos el "acceder caminando" y la "exposición al peligro" entonces sitios sin acceso peatonal y expuesto a peligros es motivo de ser un Wayspot no válido ¿Entonces porque no bloquear todos los sitios peligrosos de una vez? (Minería, Industrias, Electricidad, etc)


    Y finalmente el criterio más equivocado es sobre los accesos que NIA ocupa conceptos totalmente errados.

    Ocupa Zona Restringida, Acceso Limitado, Entrada Prohibida todos ellos son diferentes y además indica seguir las reglas del mundo real para intentar acceder a ellas.

    Cómo ya explique en este Hilo en el mundo real y en todo el mundo el acceso a un Zona Restringida, de acceso limitado o entrada prohibida; supone que debes contar con "autorización del dueño o representante legal para acceder" en caso contrario es un #delito en toda parte del mundo y parece ser que NIA no ha aprendido sobre las demandas, accidentes de jugadores o incluso la muerte de un jugador por violación de morada. Todo esto por no comprender que los sitios privados, propiedad privada industrial, propiedad privada comercial, y todo tipo de propiedad privada es "privada" y solo el dueño tiene la primicia de dar acceso a su propiedad y en todos estos lugares la entrada "no es publica" porque el dueño quiere que así sea "no quiere a toda la población merodeando al lugar" por distintas razones, por esto tiene sentido cerrar algo para que no todos accedan al lugar.

    En todos los casos de las propuestas nunca es el #dueño de la propiedad privada es quien envía la propuesta, por el contrario siempre son los trabajadores o funcionarios quien las envía. Entonces son personas que no tienen el dominio del lugar y además lo hacen a escondidas del dueño original. El problema que borrar en sitios así un PDI es problemático si el dueño real no quiere participar del proceso de eliminación, mayor aun si es un sitio gubernamental.

    Otro concepto errado es decir que no todos los jugadores tendrán acceso a todos los Wayspot, pues este precepto si es contra el espíritu de jugabilidad, juego limpio y sobre todo contra los mismos jugadores que no pueden disfrutar de un juego equitativo porque crea diferencias y desventajas. @NianticCasey-ING o @NianticAaron@BrianHoil20-PGO@BrianRose, @NianticGiffard @BrianHoil20-PGO @NianticAaron @NianticAaron

    I understand the displeasure, but does this discussion need to take place in this thread? The application was rejected and that is the end of the issue. The wayspot has now been submitted and accepted by me at the correct location. The only thing missing is that the faker is warned.
