I like the night photo better, but I feel the spirit of the niantic games is to explore during the day, and the day photo is the best photo I could get of the fountain, dispite the sun glare.
I tried to photograph the fountain during the day quite a few times, and, unless the sun is shining thru the fountain (and thus, also in frame and causing glare), it’s invisible to the camera, like in this photo:

the courtyard inside the retirement home is great for exercise. the pond with the fountain is the centerpiece. I also took a daytime photo of it, but I thought it looks better at night, when it’s lit up You can also see it in the first photo on their website: https://twincreeksretirement.com/
The fountain will defenitely get rejected for not safely accesible. I would try to search something else to nominate, like a rest area maybe or chilling spot where you can socialise with each other.
As others have mentioned, the fountain is not eligible. However, I believe that little bridge in the background is (looks like a nice little pedestrian bridge with a nice view)
You came here with one question so might be puzzled by the response see.
So to first address the question of Day and Night…..
I personally prefer your night picture of the area as you can actually pick out features a lot easier, and I love the drama of it.
There is nothing about exploring being preferred to be during the day time. Naturally a lot of it happens during the day but nothing wrong with a good well lit night photo like yours is. So when appropriate go with a night photo.
To the second part that you were not expecting, the pond aerator is not eligible. I can see why you thought it would be, but it is not for the reasons others have said.
It is tricky when you have a nice location but are struggling to find a way to see if it can be eligible and acceptable.
I agree the bridge might be a better focal point for the garden area
There are also other elements that give the impression that this is a space to relax in.
So reconsider your title.
The description needs to draw out why this is a space to explore and relax/socialise. So draw attention to the bench as place to sit and chat and relax. There seem to be several simple ornaments selected for connections to calm.
It’s not going to be easy, so as well as the commendable effort you are putting into the pictures you need to do the same with the text.

For the bridge, I would describe it as a scenic location. That looks like a perfect spot to take photos from (of the pond area) and posed on when people visit.
In some parts of the world, it doesn’t get light almost at all during the day in winter so day/night doesn’t matter as long as the photo is clear (and yours is beautiful)
I would accept this as a good place to explore and socialise with the bridge, seating and pretty pond area. You dont need to nominate the fountain specifically, I would nominate this as a whole area and talk about the social spaces with the benches and the bridge viewpoint as the focus of the nomination.
Merits of the submission aside, the night photo is better IMO.
There can be some confusion about whether night photos are eligible as there are guidelines against photos being too dark. As long as the subject is well-lit it should be eligible, for example:
Hmm. While the bride might be eligible, it would not appear in any game. There is a statue about 4 meters behind it that I submitted and is already accepted. It is also in the same cell as that statue. The waypoint name is “crossing the stream” if there is some way to look that up. I submitted it this month, and I heard that the old ingress tools don’t work on waypoints after the sale, so I haven’t tried them.
I went with the night photo, and revised the text of my submission as follows:

Surrounded by raised community garden beds, benches, and a walking path with a bridge and excercise stations, the pond and aerator are centerpiece of the outdoor community courtyard at Twin Creeks Retirement.
I have another submission in the area in voting: the bicycle sculpture you can see in the supplemental photo on the right side of the pond. I’ll have the pokestops if individual objects within the courtyard get accepted, but, I really want the pond itself to be, as it’s the focal point of a very nice area.
regarding that yoga statue, Do you think it’s eligible? it didn’t look at it closely. I thought it might be too small and not bolted down. Though it’s been there for years, as it’s in the old photo on their website. If it’s eligible, then there’s another (much less impressive) courtyard nearby with a similar statue where I’ve been strugling to find something worthy of nominations (at pear valley assisted living)
It can be confusing to see things in the game and then find they are not eligible. Standard submission principle - don’t use what you see in the game as your guidelines for what can be added.
Ineligible things only get removed if someone reports them and they meet removal criteria, which is unfortunately not matched to the acceptance criteria, so sometimes things won’t get removed even though they wouldn’t now be accepted. Pond aerators should be an easy removal due to the lack of pedestrian access.
I was about to say the same thing. That bridge should work. It’s a pedestrian bridge and scenic spot.
Incidentally, the night photo is pretty fun looking, you might be able to get the bridge nicely framed in a pretty night photo.
