Dangerous gym removal rejected

I actually made a suggestion that might help you get it removed. Another idea is to have the property owner ask Niantic to remove it.

Thank you for the previous responses i truly appreciate them. I have gathered additional, specific photographic evidence showing that this wayspot now meets Niantic’s removal criteria of “Located in a place that has unsafe access.”

The location is an abandoned construction lot that has been left in a dangerous state for years. There is no safe pedestrian path to reach the mural, and approaching it requires crossing multiple serious hazards.

The first issue that arises is that the traffic signs on the surrounding roads (that you need to reach the gym) forbid pedestrians from using the road. “voetgangers oversteken” translates to pedestrians have to cross to the other side of the road, as this is a scooter/bike path.

there is however also many issues with the lot itself, it is an abandoned construction lot thats overgrown and mostly closed off by metal fencing and the remaining wooden fencing.

if you do make it onto this lot, there is still many hazards around. there is rubble everywhere. whiich includes sharp and dangerous rocks tiles, wiring, a rusty bike.


there is also very dangerous altitude differences, holes covered up by overgrown shrubs.
it may be difficult to see, but this is a steep drop covered up with grass

it is also hard to see on the camera but this is a very steep drop with sharp rocks at the bottom of it. the top is loose sand thats prone to slide.

These are current, physical dangers that make safe access impossible. The site is not maintained, there are no ongoing works, and the overgrowth hides additional risks. Even if someone were theoretically “allowed” on the lot, the conditions are objectively unsafe.

This also directly contradicts Niantic’s own player safety rules: the gym actively encourages players (including children) to enter a hazardous, abandoned construction area where trespassing + climbing fences is required just to attempt access.

The wayspot no longer represents the original safe mural on an open parking lot — the entire surrounding location has permanently changed into a dangerous ruin. it was a beautiful spot, it simply no longer is, and wont be.

I respectfully ask the Niantic team to review this new evidence and retire the wayspot under the “unsafe access” criteria. Happy to provide any additional details or higher-resolution photos if needed.

Now this is solid evidence for me to not keep the wayspot.

The road to the wayspot is not intended for any pedestrians to use. I am now in favor to remove the wayspot.

Unfortunately, I still don’t think this enough for removal. Construction workers still have access to the construction site meaning somebody has access to the mural. I know you mentioned it is abondened, but that’s never a guarantee with just one message.

This place is actually where I grew up, so I know it is a prime location, very close to the main shopping area. So I have no doubt the construction site is temporary, and it does not look like the mural will be removed.

So I have to disagree, under normal circumstances this area is safe, and I expect it will be open to the public in the future.

I do not expect that wayspots will be closed due to temporary constructions.

thats incorrect, construction has been completely halted since 2022 with no plans to continue.

and even if it WOULD in the future move from the unsafe lot to a new project, it would become an appartmenet building and there would no longer be a mural

as of now and in the fdoreseeable future this is a dangerous unsafe lot

with no plans of change coming up.

This is wrong. You have this pop out notification everytime you login. If the area have restricted access, please dont trespass into construction area and find another gym.

It still is expected that a new building will appear. Also it is mentioned in several articles that a temporary playground is currently present at the intended construction site.

As there is currently plans in place I don’t think you can claim “foreseeable future”.

You could state that it is currently in an unsafe condition with no solid date of when this will be sorted and no announcement of what will happen to the mural when construction is completed.

We can not see in to the future so we should stick to its current state.

IMO: I agree that in it’s current situation a removal does seem like the sensible option, someone can always submit again when things change but I don’t make the rules. Niantic do and if they have decided not to remove then thats the decision.

You are correct. It’s best to stick to the facts and its current situation.

Nobody knows when the construction will start.

I’m just reporting the current situation.

I’ll see what they think with the additional information.

And accept that decision unless the situation changes

Facts:

  1. the wayspot is still at that location

  2. the construction site has no impact on the building where the wayspot is (in the artist impression in the newspaper article you can still see that those buildings are still there)

  3. from the artist expression, it appears there will still be space between the current building and the building under construction (one of the current buildings has windows on that side, so normally there should be some space left). See https://www.im-architecten.nl/project/de-mirador for evidence that indeed a sidewalk is intended to be there.

  4. there is no government indication that you are not allowed to walk there, there is only a small detour for people on bikes due to the construction site, and pedestrians are requested to walk on the other side. But this covers only a small portion of the road.

  5. according to streetview the grassy area at the end of the construction site is still open, so it looks like you can still access this area.

  6. there does seem to another wayspot in this area (not live in pokemon), that should be removed, as this one has disappeared in real life.

Don’t get me wrong, I wouldn’t mind if this wayspot would be closed, but I just don’t understand why it would meet removal criteria. I would however considered it ineligible before it was a construction site, at at that time it didn’t have safe pedestrian access.

There is no safe access to the wayspot as of now. With no knowledge on when it will be changed.

Also, as you can see above the mural is partly painted over with blue paint, it’s not fully intact anymore, so I doubt they would leave it up like that when they build high end apartments on the lot (if they even will)

I feel like if I try to clarify more it will just keep going in circles.
