I reported the wayspot/gym called “Dzia slang en vogel”

The wayspot used to be at a wallpainting on a big parkinglot, but it was demolished years ago, what is left now is an overgrown construction area that’s really dangerous to access. And getting worse. Theres fences around most parts too. The property is not to be entered.
Theres holes and rubble and plants everywhere, it’s not safe to access this gym and can’t be properly reached. This has been the case for ages and there is no reconstruction plans, this is the permanent situation as of now.
Thanks for the appeal, @SuperSolidSquid! We took another look at the Wayspot in question and decided that it does not meet our criteria for removal at this time.
I took more pictures today, it’s very irresponsible to leave this up, it’s fenced off and there’s rusty sharp copper wiring everywhere in the field. I highly doubt this meets the criteria
The artwork is still clearly there and not everbody need to have access to this wayspot.
Niantic/Scopely also encourages to follow laws and stay safe. If a location seems too dangerous to enter then it is recommened to not enter it. But this will not lead to the wayspots removal, therefore I agree with the decision being made here.
I had to go over a wooden fence to take those pictures, how does that at all follow the guidelines? The artwork is there but not accessible in a safe way, it can’t be reached properly. Yes it’s a beautiful piece of art (it’s also partly sprayed over as you can see)
But I would not request its removal if according to the guidelines this was a suitable spot.
I highly doubt niantic would want people to fight in a gym that requires them to risk their safety by glinting a construction lot., 80% of it is closed off with metal fences, the rest with wooden fences.
When this spot got approved this was a fully accessible parking lot. Which has now been demolished for ages.
The situation is only getting worse. Theres more rubble piling up. It’s irresponsible.
Anyone who can see the situation in real life would agree with this.
Gym is not needed to be accessible to every person. Wayspot can appear in restricted area like gated community, paid entrance, or gated business. If you cant access it safely, please find other gym.
As long the wayspot is still there, it will be hard to get it removed. I suggest you to move on
Doesn’t look unsafe, just a little untidy. Examples of unsafe would be in the middle of a road, or surrounded by water.
Lack of access is not part of the criteria either - the only access consideration is pedestrian access ie could someone walk up to it and stand there - which they can, and single family private residential property (ie someone’s house), which this is not.
It doesn’t meet removal criteria. The owners and anyone working on site has access. If you do not, then play elsewhere.
There is no owner and there is no workers, it’s an abandoned construction lot owned by the government. It used to be a town parking lot open to all. Which is now closed off. Lol

I guess it’s hard to convey the situation in text if you don’t know what it’s like in real life.
I’ll try to make a more clear detailed post to prevent any confusion or back and forth. I was unfamiliar with the process when I posted. If it gets rejected then I’ll indeed accept and move on

Since it got fence, meaning who put the fence is the owner. The owner can still access the wayspot safely. You dont need to access wayspot, if you need to climb the fence to get near it. You can find other gym in other place
Well no. The fence is placed by the government lol. To keep EVERYONE out…. There is no plot owner that can get to it… it’s an abandoned construction lot….
I am extremely surprised that Niantic did not remove something in a construction zone. Is there any evidence from an official site you can give that this is a construction zone? Even if it is an abandoned one?
In my opinion, this should be removed under “Safety” but “My Opinion” and “Niantic’s Processes” don’t always match.
We can assume that this location isn’t going to stay Abandoned forever so I assume there will be occasions when someone needs access to inspect etc, I assume there may be some utilities (gas / electric / water) that runs under here so their employees may need access.
I am not saying that this is why it shouldn’t be removed, more why Niantic may decide not to remove.
Wel to me it seems its under restricted access. Government staff can still access it. Its just general public cant get in. Alternately the mural seems behind building. Building owner/staff also should be able to reach it. Since the wayspot still there, i dont think its should be removed.
Its not dangerous if you didnt tresspass. Its fenced for that reason. If you cant access it, you can find other gym. Not all gym need to be accessible to everyone.
This is a lot that has been dead and empty for years.
It just entices people to play in unsafe areas.
I don’t get why this community wouldn’t just prefer a safer more welcoming experience for players.
People in the forums try so hard to keep places like this up under technicalities while the guidelines are filled with very valid reasons to close a gym like this down.
The area has so many stops and spots that would be perfectly safe for everyone to use. This one is a dangerous spot that is just a bad look for niantic and players.
There is like 37 pokestops in that cell alone. How is it in any way preferable to anyone to keep that gym up? When any other stop, even one next to it. Would be safe for everyone to use.
This location breaks multiple guidelines. And ticks multiple removal guidelines
I understand the frustration you are feeling.
However the decision about this location does not lie with community, but with the wayfarer team and the application of policies around removal.
Those policies are there to help ensure consistency.
The response from the team is that it has not been demonstrated that this meets removal criteria.
If there is no more you can do to make your case then my advice is to let this one go and move on.
Do you know if it’s allowed for me to make a more detailed post where I initially give all info and fully sketch the situation? I feel like I underestimated the detail needed for these types of posts. Theres definitely much more info on specific guidelines it breaks. Is there any use for me to do it here? Or is this just “solved” now?

The discussion points raised by your fellow wayfinders should have given you some further points to reflect on as these are areas that you might want to address.
You can gather all opinion here so you can see from other people perspective before deciding how to report again. But if you get another rejection, i suggest you to move on.
But from my point of view, if you cant access the place , please dont trespass .
