The accepted bench you shared here is a very bad example. That is not a memorial bench and should have been rejected for false information.
Generally, you can never rely on already accepted Wayspots to be actually eligible.
Now for your bench, you would need to present it so it doesn’t fall into the rejection criteria, but also follow this clarification:

If you can share more about your nomination attempt (title, description, infomration about the project) maybe the community can assist you and give you better advice
