Waystop Restoration Appeal--West Hills Community Church, San Jose, CA, USA

  • Additional Information (if any): This Wayspot was located at the church sign, with the actual church building immediately behind it. The sign itself is by a sidewalk used by dozens, if not hundreds of people every day.
    This area had 4 Waystops originally. In Wayspot Restoration Appeal--Lincoln Glen Church, San Jose, CA there is some background on the site. The mentioned appeal restored 3 of them. This is a request to restore the fourth.
    There are two churches facing each across a concrete patio.

The black outline is the West Hills church building, and the dropped pin is the location of the Wayspot at the church sign.

Hey just wanna commend you on your hard work. Thank you for taking the time to do all the research that helps reverse the collateral damage that occurs sometimes.

I think this is a harsh assessment, as there is a preschool on the grounds. Someone may have thought that the churches (yes, both were removed) were in the same building as the preschool. The locations of each was worked out in the thread linked in the OP’s post. Very easy to see why someone could’ve requested removal for K-12 school without actually taking the time to find out which building the preschool is in, and which the churches are in, and staff may have believed that the entire grounds is the preschool, thus they removed both church Wayspots.

Keep in mind that staff are human, too, and do make mistakes. This is why we have the option to appeal to have Wayspots restored if we don’t agree with their removal here in the forums.

I do hope that staff gets to this, as it seems to have been waiting quite awhile. @TallOldPhart, have you checked to see if the Wayspot was restored by any chance?

Answering in reverse order:

The Wayspot has not been restored. Last time it took 3 working days for it to be restored, and another 2 before I was notified that it had been restored.

I believe what happened with these Wayspots is that a well-meaning person reported a number of invalid stops in the area (3 actually inside K-12 school grounds, and 4 little free libraries in the front yards of single family homes). These spots on the church grounds were probably reported by mistake, since it takes a bit of research to understand the lay of the land.

My understanding had always been that as long as there is a school on the property, then wayspots are disallowed.

Being in separate a separate building would not matter.

If it is restricted to buildings, then why would outdoors facilities at schools, like tracks, playgrounds, fountains, etc, not be allowed? They would not be in the building.

Anyway, if standard is “school on the property”, then this, and the restored wayspots, should be invalid.

So, clarity on “what is a school” seems like it is necessary.

This is only about the way spot at West Hills
If you would like to open up a wider discussion about places that are primarily focussed on under 18s then can you amend this and start a new discussion in either General or review? That might be helpful.

It may be 1 parcel land but it has got 3 distinct buildings each used independently. A previous request was decided on its own merits.
The request under appeal is for West Hills Community Church and the Wayfarer Team will decide on that appeal based on the evidence for that wayspot.

Is it community church inside preschool area or is it preschool inside community church area? I believe that would define whats the area’s primary focus.

My understanding has long been that “it didn’t matter”.

What did matter is: “is there a school on the property?”

I have always read this as, “Is this school property?” A subtle but important difference.

The clarification supports my reading of this with the word primarily:

Let’s keep this focused on the restoration appeal. If you do check out the OP’s appeal to restore the other church here, staff did restore it. It’s the link in the OP’s first post for Lincoln Glen Church, and we were able to work out that the preschool is in a separate building than the 2 churches. The OP has also shown this with a map screenshot.

I hope that if Niantic decides to restore this, which I would expect they will, that they will also address the misunderstanding over “property with a school” and “school property” to avoid this happening in the future, since individual appeal decisions do not set precedent.

I think as I suggested above a separate discussion around this might be helpful. I dont see a specific clarification being done right away by staff, but it would be helpful to pick out some the key points that need to be considered. It will raise awareness of the problems but also ensure it has a global perspective.

I read it as “schools” OR “facilities primarily focused for persons under 18 years of age”.

Completely agree with you. If some want to have a discussion, it should be done in new thread. This has been waiting 10 days for staff, and I’m trying hard not to tag them, as they have been resolving other newer Wayspot appeals.

I think it is reasonably clear that the preschool is in a separate building.
The picture on their website locates the space that they use in a separate building to the church building. I don’t think they would have a directions type photo with the wrong location.

The Preschool website also states:

Explorer Preschool is located at . We lease our space from Lincoln Glen Church and are located directly behind West Hills Church.

So its not they are not affiliated or part of the church except for leasing the 1 single building.

Thanks for the appeal, @TallOldPhart. We have taken another look but stand by our decision to retire the Wayspot in question.

Can you give us any clarity on why the team made this decision?
