I used a photo from my camera roll so I guess that flagged the third party since it wasn’t taken live on scene?

The text says “…contains abuse, ridicule, or harassment-” those three are independent. It might be better phrased “abuse OR ridicule OR harassment.” It is only implying abuse, there is likely no ridicule or harassment involved.
As to the third party photo, using photos you’ve taken yourself and saved to your camera role is acceptable, however it is not acceptable to use photos taken from third party sources, ie from the internet.

Oh wait so is that the abuse? There are 2 bullet points and I’m trying to figure out how to resolve the second issue. I don’t want to go and take a photo and then find out I’m still abusing/ridiculing/harassing a group or person. Unless the second bullet point is just a byproduct of the photo being bad as well? Yes, it is an abuse. Use of a third-party photo could result in Niantic being sued by the owner of the photo for copyright royalties and compensation for unauthorized use.

None this was my first submission ever I was just trying to understand how the system worked
