In my opinion, the removal of the portal was unjustified. The object to which the portal was attached still exists and meets the criteria for an Ingress portal: it is publicly accessible, culturally or historically significant, and safe to access. I agree that the portal was removed without reason.
While it is indeed a great initiative for the local community, similarly to the playground at the same location that was removed for the same reason (Galvės Sodu Eikštele), it doesn’t change the fact that it’s on a private residential property whose owner can selectively choose who can access it and who cannot. In fact, the last time I visited it together with a fellow player, we we’re met by the owner and guided back to the parking lot.
You should continue doing good things for the local community, but there is a reason why in-game objects are not allowed on private residential properties and therefore no exception should be made in this case.
If you say this is private property, please attach a photo, you can come with your colleagues and measure how much and how far from the private place it is, and I would advise you to lie a little less, that I had to leave something here to the car from the private territory , that it is not a private territory, it is a public one. It might be an indication that pedestrian traffic is not really allowed at the place. Perhaps because it goes through private lands or because it is too close to the nearby highway.
I can confirm the words of this user (E2winkas666) that this is the official government territorial planning website regia.lt where the coordinates and territories are unchanging and fixed. Google maps and OSM do not have future objects layers of those territories, so they are updated once a year to a Google. All speculation with other maps is almost fake talk, because in the future a path is planned there. By matching the coordinates of the portal and the coordinates of the government map, it is clearly visible that the book house is outside the boundaries of the private territory. In the following messages, the green lines mentioned by imantas are the real direction of the future path and they are protected from the highway by a curb, barrier and trees. He should have seen this when he passed there. He even could have freely driven there by car.

We are waiting for a response regarding the permit, but as our community chairman said, it is a very good initiative and no one was against the idea of a book house being built in this location. I think it will be official in 1-2 weeks that the house will be built with the coordinates in this location.
Than you’re probablly too early for your appeal. When you can add the municipal permission this could be a perfectly fine wayspot. But until that it gives the impression that you’ve put it out of the private border to make it look like an eligible POI.
Please don’t take it bad, I want to help you make a good case.
You’re right, I did it first and now we’ll register it. All the community members are satisfied, the children visit and we share books, but since we’re going with that, and so that there are no other questions, I’ll do everything legally with permits, so I think we’ll wait 1-2 weeks and everything will be legal and it will be clear to everyone where it’s private property and where it’s municipal. @AliceWonder1511 since the object in question is not visible on the map and there are no good anchor points visible in both the map and the pictures, it makes it challenging to determine where the boundaries of the private property are in the attached pictures, and especially challenging for someone who visits the place physically. The red X marked on the map does not look particularly accurate as it’s marked directly on the path, but in the pictures you can see that the mini library is few meters away from the path.
While a fence may not be a good evidence for determining the exact location, it is what players rely upon in real world when in question of where the private property boundaries are. An object outside of the fence is much more welcoming for local players than an unbounded place that looks like someone’s backyard.
I wanted to visit this wayspot again but noticed that it was missing. Quite odd that imantas assumed that the object is on private property, since I had no issues arriving at the object, parking nearby and seeing the property markers (also visible in the photos) which were clearly indicating that the object in question was outside of the nearby private property. I was also able to easily scan the object, making sure not to step over the property markers to ensure that I was not intruding on anyones private space. To me, it seemed like a great wayspot, that is easy to access, with genuine value to the local community and not in violation with any of the wayspot criteria. Seems to me like it was reported out of spite.
Appeal again and report abuse. This is why i hope scopely will improve this whole removal-appeal removal situation. Whoever handling the removal may not be the same person who handle appeal here. I am not sure on what basis is the removal. But its quite frustrating situation.
