Welcome to the forum!

I understand that in some parts of the world, it is very common to see graffiti as Pokestops or gyms, but vandalism is not eligible. Please see this clarification:

Graffiti will be removed if reported.

reviewers have to make a call on whether its a Mural that is likely to remain in place for a long time or Grafitti that could be covered up quickly.

The added tagging suggests that this may be covered up sooner rather than later.

If you can add any evidence that this was not done without permission you would have more chance. otherwise it is classed as vandalism.

Taggers do put tags over legitimate murals, so that alone doesn’t discount it. However, reviewers make a judgement call on “is this a mural or graffiti” and the vast majority are going to consider this to be graffiti, which is not an acceptable wayspot.

Agreed.

What I was trying to suggest that even if the business owner had authoried this and reviewers voted it through as a Mural, as the tags get more and more it is likely that the business owner is goint to get it covered up.

Having looked at street view this one has been around for about 3 years. Previously there was different street art that goes back abut 5/6 years then different again.
So it is an area where street art is not an issue. Whether this is acceptable is open to personal views.

Una cosa es un mural y otra un grafitti, legalmente los grafittis no pasan por vandalismo, cuando pasan es más suerte…

I can only state as it is in the UK. We may also use Mural / Graffiti incorrectly to make it easier to discuss.

Mural: Authorised by the property owner or the local council.
Graffiti: Done without authorisation.

Using the above, in the UK Graffiti is classed as Vandalism so Niantic has to show that it isn’t endorsing it.

As the submitter, it is down to you to show evidence that either it is authorised or that Graffiti is not against the law in your location.

Good luck.
