Yes, it does appear that Surtidor Shell Antiguo is the Wayspot for the L17 S2 cell that the gym is actually in, and Calavera Negra is in the cell to the east, so even if the gym was approved, it wouldn’t be eligible to be a stop/gym in PoGo.

I have this written up for when I see a wheresmypokestop question. I know the prompt tells you that you are submitting a “Pokestop” but you are actually submitting a Wayspot to the database. The Wayspot can only become a Pokestop or gym if it is alone in a level 17 S2 cell. The S2 cell use has not been officially confirmed as far as I am aware, but staff has acknowledged there is an additional step after acceptance. It may be possible that staff thought you were trying to purposely misplace the gym, but I find it somewhat odd since the cells here are occupied. Here’s what they look like for reference:
