I would definitely agree, I think the question is: in a case where the wayspot is on public land but the land is managed as part of a private residential property, is that counted as public or private land?
There may be some other examples in different parts of the world too.

It does not appear to be on Single family Private residential property.
There appears to be a local attitude that means you can take care of that area but it does not make it yours. I have seen plenty incidences locally of this sort of area being āadoptedā.
Attitudes to what happens outside your home vary. We apply local sensibilities about this.

That would be great, if it actually worked. However, apparently local sensibilities differ dramatically, even locally. In this case someone had the way spot removed, perhaps using SFPRP as the reason (donāt see any other clear reasons) and the OP is arguing against that. In the US, we get frequent disputes over this issue here on this forum.
I still think clearer official Niantic guidance would be very helpful.

Wayfarer will decide on this specific wayspot.
But the outcome will only apply to this wayspot and is wonāt be case law to use on other wayspots.
Time to be patient and wait.
No, my point is not about this way spot alone, itās repeating a call to Niantic to provide better guidance on this topic more broadly. I know many would appreciate it.
Clearer guidance might prevent these back and forths in the future.
I think this is a bit of an edge case, not necessarily a broad topic because usually the delineation between PRP and public land is clear. Thereās a sort of opposite case in the UK of historic post boxes mounted in the sides of PRPs.

Thanks for the appeal, @DonaldCZ. We have taken another look but stand by our decision to retire the Wayspot.

What? Are you serious? How do I explain that this is not private land? The players in our location are convinced of the correctness of the nomination of this wayspot, because it meets all your criteria for nominating wayspots. Itās your decision and itās a bad decision, bad for the game, especially for the game in our area. Youāre killing the game with decisions like that.
Nia never confirmed that this was removed because of private property. I would question the eligibility of the object itself. Niantic has been removing low quality stuff/coal. This could also be the reason.

I understand your frustration with the outcome.
You put a lot of effort into making the case.
You have to accept that when you appeal a decision might not go the way you hope.
You need to remain respectful to those that have made the decision.
Take some time, but it is probably best ( although hard to do) to move on from this.
