I think it matters who gets your nomination in review. Niantic’s refusal to make a clarification on these and give us a clear way to reject them with a “does not meet criteria” option in the review flow has made these difficult to evaluate. Just a thumbs down on the last three questions does not reject, according to the November 2023 AMA. So they may get accepted by some reviewers who think they are rejecting them. Or some reviewers may just accept since they see them live in game. They rarely meet removal criteria (whatever that internal guideline is) if accepted.
I can’t guess how the appeals reviewer will see this, especially since I haven’t seen the nomination yet, but I did see a post here of an appeal incorrectly rejected as being “a generic neighborhood sign” fwiw.
If you do decided to appeal, address how it meets eligibility criteria.
