If someone has absolutely no idea where they are and where they were - yes, it would have been an easy mistake to make But then reviewers or Niantic’s ML should have caught that and rejected it.
Do you submit remotely from a long distance? I don’t think I have ever made this error, but I have almost done it. It is very easy to get lost where you are on the map when you are moving the pin a long way.
I do agree with you that reviewers should have done more checking. But not that punishments are deserved.
My guess is that the photo was taken from a car - Google Maps - and then the nomination was submitted at the gas station while getting gas or something else.
Also, I have been warned for not seeing a mural that I reported as removed. I don’t see why others can’t be warned for not being careful enough when nominating.
And another thing - “rooftops are similar” implies that the submitter somehow looked at the rooftop of the cafe before submitting. The only scenario I can think of in such case is that the submitter checked the map of the correct location but then selected incorrect location in game. This is a bit more complicated explanation than submitting from the gas station and just leaving location of the gas station.
And finally - if the photo was indeed taken from inside a car, the nomination would then meet rejection criteria for ineligible photo.
Rejection criteria and removal criteria are not the same thing, and once an eligible Waypoint has been approved a new photo can be submitted. Cafes can be eligible, and you don’t have access to the nomination information on this one. Niantic does.
As far as pin placement from the site or remotely goes, we do not, cannot, and will never know how this was submitted. We can speculate all day, but there is no way to prove you are correct one way or another on this one. It’s a red herring argument.

Correct. They are, as long as submitted location is correct and as long as photos are not taken from a car.
Also correct. They are not the same thing. But I am not appealing this rejection based on its photo. I am appealing based on its incorrect location. All I said was that if the photo was taken from a car, it would be another reason for rejecting this nomination, in addition to its incorrect location.
Notice I quoted your second instance of this “guess” and not your first. Your first “guess” was a innocent observation and comment just as Cyndies. Your final claim however stands no merit.
I can claim that the idea about mixed up rooftops has 0 evidence and thus such guess is not needed. Is there some guideline about which guesses are innocent observations and which have no merit and thus are not needed?
The claim that the photo was taken from a car was actually my first guess, in response to @cyndiepooh 's rooftops guess. To which I provided evidence, btw. The final “claim” you quoted follows logically from my first guess and would serve as another reason of why this wayspot should have been rejected, in addition to its incorrect location.
A little clarification: the photo taken from a vehicle isn’t a reason to reject a nomination or photo. You can take acceptable photos from a car provided you can get close enough with a good enough angle. That said, having parts of the vehicle visible in the photo is a valid reason to reject a photo.
This photo isn’t fantastic, but it’s by no means a reason to reject the nomination, or as a photo edit.
