Mural at the outside wall of a private residence beside public street walk

Hello guys. Not sure if this is the right place to ask.

I appealed one of my nominations several days ago and it was rejected by Niantic with the reason below:

Thanks for the appeal, Explorer! The nomination is on the property of a private residence which makes it ineligible. Hence, we are unable to reverse the decision. From my understanding, the mural itself is on the property of a private residence, but it lies outside beside a public street walk. It encourages exploring, and in order to explore it people only need to stand on the public street walk instead of walking into the private residence, and don’t even has to touch it in order to explore it. So it has nothing to do with private residence here.

Am I wrong? If yes please help me clarify. The picture itself i think is a good piece of art with unique design.

What a cool wall art! Yes sometimes it make no sense, this wall is ad public sidewalk for everyone to see and touch,

But if it where on a appartment and only reachable fot the famillies living there, then it was accepted,

If there life 1 familly it get rejected
If there life more famillies on top of eachother it get accepted, like appartment or flat

It’s still on a single family private residential property so the rejection is correct.

What a great mural.
However, because it is on the wall (even though it is on the public accessible side) of a single family private residential property it is not in a suitable location.

I appreciate how frustrating that is but this is one of the areas that Wayfarer has been clear about.

The mural in this case does exist, however, it’s ineligible to be a Wayspot as it’s part of a wall on private property.

Also, I’ve noticed that you have been posting on several different threads and at times are off-topic. Please make sure you are on-topic when replying.

If a Pokemon ran into someone’s bedroom or back yard, a trainer could jump the fence, peek in the window, ring the doorbell asking permission, etc. Also if there’s a raid there, they could block their driveway so they can’t get to work. Or be loud into the wee hours while they’re trying to sleep.

These are all things that have happened - and the homeowners sued Niantic.

I don’t know what could happen with it in Monster Hunter Now, or whatever future games Niantic hasn’t released yet, or hasn’t even created.

Je ne sais pas si cela a changé dans les directives depuis cette publication mais je viens de lire ceci dans les conseils de soumission de wayferer et est-ce qu’il n’y a pas une contradiction ? C’est écrit qu’une proposition sur le mur extérieur d’une propriété privée est accepté.
Donc je ne comprends pas où est la différence entre les 2 exemples

The confusion is the words “private property” and I am not sure how well this will translate. The “private property” that Niantic does not allow is “Single Family Private Residential Property” only.

This example shows something is eligible that is on the side of an apartment building, which is not an SFPRP location.

Pour ne pas me tromper, si je comprends bien, cela veut dire qu’une statue, peinture ou sculpture ou fresque murale ou mosaïque qui se trouve sur un mur extérieur d’une habitation familiale donc privée doit toujours être refusée ? Car je vois énormément de pokestop ou proposition qui vont montrer une œuvre artistique mais qui se trouvent pour la majorité sur des appartements familiaux ou sur le devant de maisons familiales privées. Par exemple, lors de mon voyage à Strasbourg en France, beaucoup de maisons privées sont typiques de l’architecture alsacienne, des balcons, des sculptures de la renaissance sur le dessus de porte d’habitations privées sont validées en pokestop.
Donc j’ai du mal à comprendre ce qui est accepté ou pas.

Correct. There are many wayspots which have been incorrectly accepted, and long ago, access from the sidewalk was considered good enough. But today, any on the boundaries of single family private homes are not considered eligible. These existing ones can be reported for removal.

I hope someone who can read both messages without translating will respond to make sure there are no issues arising from translation.

el mural esta del lado de la calle con acceso publico, no es parte de propiedad privada, deberia ser aceptado.

As long as the wall belongs to a single family home it stays ineligible. It doesn’t matter from which side you can see, reach or touch it. The only question is who owns the wall.

Hi, I know that this is one of the problems that newbies to Wayfarer just can’t seem to accept, as I have been there myself. However, as is common in most countries and regions, all buildings and structures on land are considered to belong to the owner of the land. The exception to this is that a person who is not the owner of the land may acquire a leasehold interest in the land and establish a building. Either way, the ownership of the walls rests with the owner of the house and land.
@AliceWonder1511 is right, and @elijustrying already mentioned that in this discussion in August 2024, citing the wayfarer team administrator’s notice.
