Y’all. All this talk about a legal right to put a game location in front of someone’s home. How about being considerate?
City ordinances should over rule Wikipedia.
As I said, if it is public property and maintained as such (by the city/county/town/etc.), sure that’s clearly public. But as you also say this varies and in the US most places consider this part of your yard. It might be a public easement, but it is not public property for public use.
I get that, but this person owns the house and wanted it there.
Did their neighbors?
So now everyone with a house can have a Pokestop in their own front yard …. YAY!!!
Just kidding, I that is highly inappropriate.
You’d have to ask OP if they asked their neighbors before they put up the LFL. I’m guessing they’ll get more traffic from the LFL than the POI.
If it weren’t US$350 I would have bought one years ago.
This whole thing is Niantic’s fault imo. They removed the “closely consider within 40m of a driveway” wording. They opened the floodgates for this. I will not be responsible for putting a game location in front of someone’s house.
It’s their front yard, why would they ask neighbors if they could install LFL on their land? They might need to ask the local authorities though, in many places there are restrictions on permanently installing structures like that.
I agree wholeheartedly. The argument I keep hearing to allow LFLs or other similar POIs in peoples’ yards just sounds to me like “hey, I found what some think is a loophole so I can get my own Pokestop/portal.”
I agree it isn’t just about legal documents and ordinances which vary. If the area is generally considered someone’s yard, that’s should be all that matters no matter the local ordinance on public easements. If the home abuts a clearly public area maintained by the city as a public area, that’s completely different.
Aha, so you admit, it’s her land. Exactly!
Sorry, that was just sitting there to say
That’s cool! In my area, we love them and they are used daily. For books as well as POI’s. You don’t have to approve them, just keep your bonus location away from here! HAHAAH #cheers
When I see these arguments about disrupting the neighbors’ peace, I recall how my town used to select places for children to catch their school-bus.
There were no negotiations. The town only considered proximity to homes with school-aged kids, and selected spots that could accommodate six to twelve people.
You do not own the right or privilege to expect nobody to loiter on a public sidewalk.
What was that address again
That’s really not the issue. It’s about what is and is not someone’s home. I mean, loitering is actually illegal and you could call the police to have people move on from in front of your house, but again, it’s more about what people can reasonably consider their home and what is truly public space, which is publicly owned and maintained.
In the US governments impose public easements on private property for the ease of installing things like walkways and utilities, but the intent is rarely that the govt plans to maintain a piece of people’s yards for the right.
But the folks who want their own poke stop or portal in their yard with cling to this for dear life.
They are all legit! But I added a tight crop on the photos. Because I know how some people act here on the forum. Hahahaha
Thought I would remind you all of this clarification.
The rest of the world watches as another example of where do they draw the line in the USA unfolds.
I still think the suggestion I made in the first comment here is the best one if the OP wants this in game: appeal to Niantic. The conversation on this post going nowhere towards a consensus on the “Private Property or Farm” rejection at least proves that it will be hard to get reviewers to accept this, although some might.
I agree! I appealed a little while ago! Hope it goes through!
Please let us know the result either way! I am really curious.
