Can I make a pokestop where there’s a way spot?(keep in mind the way stop isn’t in the game)
If a wayspot exists on the map, but is not in Pokemon Go as a Pokestop, it isn’t going to become one if resubmitted. The most common reason for a wayspot not being in PoGo is the inclusion rules: Why an accepted Wayspot may not be used in Pokemon Go (S2 cells and Pokemon Go)
Trying to submit a wayspot again will usually lead to it being declined as a duplicate.
Do want to clear some things up, as not all of what @darkersolstice noted is accurate.
It’s possible the Wayspot may be an import being used as a Power Spot, or in another Niantic Scopely game. If you go to the nomination map and click on the orange exclamation point, it should give you some additional info. If there is no photo, it’s likely an import that may only be used as a Power Spot and/or in other games. Here’s one that’s near where I live that’s a Power Spot import:

Also, these do not show up as duplicates on the Wayfarer map and if you nominate something that has been imported, it shouldn’t get marked as such. If you are nominating something else that isn’t on the map as an orange exclamation point, then there shouldn’t be an issue. It’s quite rare for a nomination of a POI that has been imported to get rejected as a duplicate; I nominated a locally owned bookstore that had an imported Power Spot and it was approved by the community, as the import isn’t shown to reviewers.

Now, we aren’t creating stops/gyms in Wayfarer, but Wayspots that get added to the database map that all Niantic Scopely games can pull from. Please read the info about S2 cells provided previously; I just wanted to add some context on what you could be seining on the nomination map.
